NSW Swifts & Tyrepower “Win the Ultimate Netball Game Day Experience” Competition (Promotion) – Terms and Conditions

A. Defined Terms

Eligible Purchase means, for the Promotion, the purchase, by a Participant, of the following tyres and/or service/s from a Tyrepower NSW store (see https://www.tyrepower.com.au/stores/nsw) in a single purchase and within the Eligibility Period:

  • Two (2) or more tyres from one of the following brands: BF Goodrich, Cooper, Falken, Kumho, Maxxis, Michelin, Mickey Thompson, Pirelli, Toyo, Vitora, Nitto, Dunlop, Goodyear, Bridgestone, Hifly, Terrafirma, Yokohama, Continental
  • Any one (1) of the following services: Fitting on two or more new tyres bought from Tyrepower, Wheel Alignment, Brakes, Suspension or Mechanical Services

Eligibility Period means, for the Promotion, the period commencing on 9:00am on Saturday, 10th May and ends at 4:00pm on Monday, 31st of June 2025.

Promotion means:

(a) Entry into the draw for the chance to win the ultimate netball game day experience at Round 13, NSW Swifts vs Sunshine Coast Lightning game being played at Ken Rosewall Arena in NSW on Saturday, 5th July 2025, including corporate box seats for four people, including the delivery of the match ball on court, valued at $2500 (respectively Prize and Draw Promotion); and

Promoter means Tyrepower Marketing (N.S.W.) Limited ABN 74 006 180 301 and NSW Swifts ABN 19 001 685 007

Promoter Privacy Policy means the privacy policy found at https://www.tyrepower.com.au/terms-conditions and/or https://netball.com.au/privacy-policy.

Promotion Period means the period commencing at 9:00am on Saturday, 10th May and ends at 4:00pm on Monday, 31st of June 2025.

B. General Terms & Conditions of the Promotion

Participation in the Promotion is subject to:

(a) an individual having registered their details on the Promoters’ websites during the Promotion Period (https://www.jotform.com/assign/251168046766059/251168264517055) (respectively Participant and Registration); and (b) these Terms and Conditions.

By participating in the Promotion, a Participant is deemed to agree with these Terms and Conditions.

A Participant is permitted one (1) Registration.

Participation in the Promotion is only open to NSW Swifts Members aged 16 years or over. Participants between the ages of 16 and 18 years must have parental/guardian approval to participate and, further, the parent/guardian of the Participant must have read and consented to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of their consent to a Participant aged between 16 and 18 years participating in the Promotion.

Employees (and their immediate family members) of the Promoters and its related bodies corporate, Promoter dealers and resellers, and agencies associated with the Promotion are ineligible to participate in the Promotion.

All Registration details provided become and remain the property of the Promoters. The Promoters may use the Registration details for any commercial purpose, including future promotional marketing and publicity purposes.

All personal information about a Participant detailed in their Registration will be protected in accordance with the Promoters’ Privacy Policy. All Participants who choose to ‘opt in’ consent to have their contact details released to the Promoters and to receive ongoing marketing material and communications from the Promoters and agencies associated with the Promotion.

The Promoters reserve the right to verify the validity of Participants and their Registration.

If for any reason the Promotion is interfered with or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant, or (b) modify, suspend, terminate or cancel the Promotion.

The Promoters’ decision on all matters relating to the Promotion, including in finalising any disputes that may arise, is final, and no correspondence will be entered into.

The Draw Promotion runs during the Promotion Period and is subject to the below terms and conditions.

Participation in the Draw Promotion is subject to a Participant having completed and submitted a valid Registration during the Promotion Period.

The Draw Promotion is a game of chance, and one winner will be picked at random from eligible Participants at the end of the Promotion Period.

There is one (1) Prize to be won across the Promotion Period.

The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash.

The winner will be notified via text, telephone or email by the Promoters within 7 days.

If the winner does not redeem, claim or otherwise take the Prize (or an element of the Prize) within 5 days of being notified by the Promoters, then the Promoters may either (a) award the Prize to another valid Participant, or (b) treat the Prize as forfeited.

If the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize for a prize of equal or specified value, subject to government requirements.

The Prize will be awarded to the winner except when the winner is under the age of 18 years, in which case the Prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

The winner should seek independent financial advice related to the Prize.

The Promoters shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the Prize, except for any liability which cannot be excluded by law.

C. Terms & Conditions specific to the Promotion

The Promotion is not available in conjunction with any other offer and is subject to the below terms and conditions.

Participation in the Promotion is subject to a Participant having completed and submitted a valid Registration during the Promotion Period via the Promoters’ websites (https://form.jotform.com/251168046766059)

The Participant will need a copy of their purchase receipt in order to register their Eligible Purchase with the Promoters.

There is a strict limit of one (1) entry per Participant regardless of (a) the number of Eligible Purchases made, and (b) whether the number of tyres or services purchased in any given Eligible Purchase exceeds the minimum purchase requirement.

The Promotion is subject to a Tyrepower NSW store possessing stock the subject of a Participant’s intended Eligible Purchase. The Promoters, whilst it will take reasonable steps, makes no representation or warranty as to the quantity, types, or sizing of tyres any given Tyrepower NSW store may possess during the Eligibility Period. No ‘rainchecks’ will be available to a Participant in the event that a Tyrepower NSW store does not possess necessary stock to fulfil or complete an intended Eligible Purchase.

Other than those brands listed, the Promotion is not available on any other tyres sold by the Promoters.

The Promotion cannot be combined with any other offer including, but not limited to motoring club discounts, VIP card programs and all other promotions.
